RE:  Entity Registration Applications – Registration of Entity for Receipt of Commissions and Other Valuable Consideration

This is to advise that New Jersey licensed real estate salespersons, broker-salespersons and referral agents may now register with the New Jersey Real Estate Commission a limited liability company or other entity permitted by law (collectively, “entity”) formed pursuant to N.J.S.A. 45:15-16 to receive a commission or valuable consideration for real estate brokerage activity.  

To register, applicants must submit all required documents electronically through the Commission’s Online Portal system.  Specifically, applicants must submit the following two documents issued by the New Jersey Department of Treasury: 1) Standing Certificate; and 2) a certified copy of the Certificate of Formation or other formation document (for New Jersey formed entities) or a Certificate of Authority to transact business in New Jersey (for entities formed in a jurisdiction other than New Jersey). The required $50 processing fee is paid online through the application by credit card. The entity must not receive any commission or other valuable consideration until approved by the Commission.

PLEASE NOTE: The establishment of an entity to receive commission or other valuable consideration is an option for eligible licensees under state law and is not a requirement for licensees. A broker may still pay an individual salesperson or broker-salesperson directly. However, to be paid through an entity, the entity must be registered with the Real Estate Commission.
